Validity of Terms
Agreement Overview
This agreement constitutes a binding set of terms and conditions between you (the user) and SIMPLESPACE LIMITED (Address: Room 532B, 5/F, Star House, 3 Salisbury Road, Tsim Sha Tsui, Kowloon, Hong Kong), collectively referred to as "OpenRoamly," "we," or "our".
This agreement governs the services ("Services") through which you obtain international data plans ("Data Plans") and related prepaid eSIM technology ("eSIM") from OpenRoamly for use on your personal device ("Device"). These terms are specifically designed to govern all transactions involving OpenRoamly's eSIM resale services.
Scope of Application: The following terms and conditions apply to all services related to the resale of prepaid eSIMs provided by OpenRoamly.
These terms and conditions are provided on the website https://www.openroamly.com. OpenRoamly does not accept any conflicting terms unless explicitly agreed upon in writing.
Service Description
eSIM Resale
OpenRoamly resells prepaid eSIMs. Customers register and purchase eSIMs on the website https://www.openroamly.com and/or the OpenRoamly application.
Registration Requirements
Customers must accept these General Terms and Conditions to use OpenRoamly services. Customers provide the following information on https://www.openroamly.com, either directly or through a service provider (hotel, travel agency, etc.): first name, last name, address (billing address), email address.
OpenRoamly Commitment
OpenRoamly shall use reasonable efforts to provide customers with quality service. However, OpenRoamly does not guarantee that the service will be uninterrupted, timely, secure, or error-free.
Customer Responsibility
When using the device or services provided by OpenRoamly, the customer shall not engage in any abusive, illegal, or fraudulent activities; nor shall they cause network impairment or damage.
If the customer violates the obligations stipulated in Clause 2.4, OpenRoamly may suspend the customer's use of the service. During any period of suspension, the customer shall continue to pay all fees incurred under this agreement for the suspended service.
Device Compatibility
The customer is responsible for ensuring their device supports eSIM and is not network-locked. Device compatibility may depend on the carrier and country of origin, and the customer must check the list of compatible eSIM devices provided at checkout.
By ticking the checkbox confirming device eSIM compatibility, the customer is responsible for the accuracy of the information provided.
The eSIM compatibility list is not exhaustive, meaning newly released eSIM-compatible devices may not yet be added to the list.
Contract Commencement, Term, and Termination
The service contract between OpenRoamly and the customer commences upon completion of the order on the OpenRoamly website https://www.OpenRoamly.com or via the OpenRoamly application.
Activation Responsibility
Activation of the eSIM and confirmation of the activation policy are the customer's responsibility.
The contract will terminate if the customer does not have an active data plan or has deleted the eSIM from the target device.
Fees and Payment
Payment Conditions
Payment methods supported for OpenRoamly services include credit/debit cards, PayPal, Google Pay, Apple Pay, and Alipay.
The payment currency is US Dollars ($). Credit card transactions will be processed and secured by OpenRoamly's providers, PayPal (https://paypal.com) and Stripe (https://stripe.com).
Usage Fees
Unless otherwise stated, OpenRoamly states that all fees include VAT. The customer is not entitled to offset any of its claims against claims of OpenRoamly, unless the customer's claims are undisputed or have been confirmed by a final court judgment.
Delivery Method
Instant Delivery
The purchased eSIM can be viewed immediately after purchase by the customer under the "My eSIMs" tab on the OpenRoamly website https://www.OpenRoamly.com and/or the OpenRoamly application.
The customer will receive a confirmation email after purchase. All information for installing the eSIM can only be viewed in the user's OpenRoamly account.
Refund/Cancellation/Modification Policy
If the eSIM cannot be installed and used due to technical issues with OpenRoamly, the customer has the right to request a refund or a replacement eSIM.

Modification Policy
OpenRoamly's eSIM data plans are provided as-is and cannot be further modified or customized upon individual requests after purchase.
Liability and Warranty
OpenRoamly is not liable for damages arising from the non-continuous availability of the proposed service. OpenRoamly does not guarantee the continuous availability of network services.
No form of refund or compensation will be issued for expenses incurred using backup phones, backup SIM cards, backup providers, hotel phones, or any other costs not directly related to the customer's OpenRoamly eSIM account.
